HOLIDAYS - QUALIFYING Clause Samples
The 'Holidays - Qualifying' clause defines the criteria under which an employee becomes eligible to receive holiday benefits, such as paid time off for recognized holidays. Typically, this clause outlines requirements like minimum length of service, employment status (full-time or part-time), or whether the employee must work the day before and after a holiday to qualify. Its core function is to ensure clarity and fairness in the allocation of holiday benefits, preventing misunderstandings about who is entitled to paid holidays and under what conditions.
HOLIDAYS - QUALIFYING. A regular employee shall not receive holiday pay if said employee fails to report for scheduled work on the holiday or fails to report for scheduled work on the day immediately preceding and the day immediately following the holiday, unless such absence is permitted or excused by the Company (i.e., regularly scheduled day off, or the day paid under the terms of the Collective Bargaining Agreement).
HOLIDAYS - QUALIFYING. Article 17.01 applies only to employees who have attained regular employment status and who have worked the regularly scheduled work day before and the regularly scheduled work day following the holiday, unless their absence is due to illness, authorized leave of absence, or vacation. In case of an employee’s illness or injury, the Employer shall have the right to request a certificate from a qualified medical practitioner.
