Hiring Queries. Where a member of the bargaining unit, or an individual who possesses a Right of First Refusal, or the Union on behalf of an applicant for a posted position, has concerns either about the procedures which were followed or the substance of the decision which was reached in a particular appointment, a request for review of the decision may be filed with the AVP (Human Resources) (or designate), copied to the Union. Such request shall be set out in writing, and filed within ten (10) working days of being advised of the decision. The Department of Human Resources shall respond in writing within ten (10) working days, copied to the Union, providing the procedures followed and all relevant non-confidential information which formed the basis of the decision. In addition, the Union shall be provided the names of the applicants and a current curriculum vitae for the successful candidate. A grievance may be filed in accordance with paragraph 3.07.02 within ten (10) working days of receipt of the response.

Such request shall be set out in writing, and filed within ten (10) working days of being advised of the decision. The Chair shall respond in writing within ten (10) working days, copied to the Union, outlining the reasons for the decision. A grievance may be filed in accordance with paragraph 3.07.02 within ten (10) working days of receipt of the response. The Union may request that the employer conduct a hiring query on its own behalf, without naming a specific applicant, where there is concern regarding a Department’s hiring process and/or where the concerned applicant does not wish to disclose their identity. Anonymous hiring queries should not be used the majority of the time that a hiring query is requested.

Hiring Queries. For positions totaling sixty (60) hours or more in an academic session, in which two or more equally qualified candidates apply, the Union shall be eligible to submit a hiring query to the chair of the department to inquire as to the reasons of the decision.
