HIPAA Data Clause Samples
HIPAA Data. Customer agrees not to upload to the SkySQL services any HIPAA Data unless Customer has entered into a BAA with MariaDB. Unless a BAA is in place, MariaDB will have no liability under this Agreement for HIPAA Data, notwithstanding anything to the contrary in this Agreement or in HIPAA. If Customer is permitted to submit HIPAA Data to the SkySQL Services, then Customer may submit HIPAA Data to MariaDB and/or the SkySQL Services only by uploading it as Customer Data. Upon mutual execution of the BAA, the BAA is incorporated by reference into this Agreement and is subject to its terms.
HIPAA Data. You agree not to upload to any Snowflake Service any HIPAA Data unless You have entered into a BAA with Reseller, and in any case, never to provide HIPAA Data other than by uploading it as Customer Data to the editions of the Snowflake Service which are specifically designated for HIPAA Data in the Documentation.
HIPAA Data. (a) ▇▇▇▇▇▇▇ is not a “business associate” of Customer, as the term “business associate” is defined by HIPAA (the Health Insurance Portability and Accountability Act of 1996 and 45 C.F.R. parts 142 and 160-164, as amended). All medical information and/or data concerning specific patients (including, but not limited to, the identity of the patients), derived incidentally during the course of this Agreement, shall be treated by both parties as confidential, and shall not be released, disclosed, or published to any party other than as required or permitted under applicable laws.
(b) Customer acknowledges and agrees that ▇▇▇▇▇▇▇ may use any data arising from or related to the performance or use of the Equipment or Services.

Unless a BAA is in place, Genie will have no liability under this Terms of Service Agreement for HIPAA data, notwithstanding anything to the contrary in this Terms of Service Agreement or in HIPAA or any similar federal or state laws, rules or regulations.
HIPAA Data. To the extent applicable, unless Customer has entered into a BAA with Glean, ▇▇▇▇▇▇▇▇ agrees
