Common use of Higher Market Value Clause in Contracts

Higher Market Value. Nothing in this Assessment Agreement shall limit the discretion of the city assessor of the City of Delano or any other public official or body having the duty to determine the market value of the Land, the Project and other facilities on the Land for ad valorem tax purposes, to assign to the Land, the Project or to any other improvements constructed on the Land, on a nondiscriminatory basis and treated fairly and equally with all other property so classified in the respective counties, a market value in excess of the minimum market value specified in Section 2.01. The Owner agrees not to contest any estimated assessor’s estimated value in excess of said minimum market value.
