Common use of Hearings and Decisions Clause in Contracts

Hearings and Decisions. At Steps 2, 3, and 4, hearings shall be held, if requested by the employee, in writing, at the time of invocation of the particular step. The hearing must be within the response period. The decision must then be rendered within five (5) business days of the hearing. Failure of both the grievant and the Union representative to appear at the hearing, without good cause, shall constitute a final denial of the grievance. The hearings shall be informal and conducted in as expeditious a manner as possible, consistent with the grievant’s right to make a full statement of their case. The parties shall provide relevant documents and witnesses reasonably necessary for the processing of grievances.
