Common use of Formal Written Grievance – Level II Clause in Contracts

Formal Written Grievance – Level II. If the grievance has not been resolved at Level I, the grievant may present a formal written grievance on the appropriate form (Appendix M) to the immediate supervisor within ten (10) workdays of the oral decision of the supervisor. If the grievant does not present such grievance in writing within the above stated time period, the grievance is deemed to be resolved. The written information shall include: a description of the specific grounds of the grievance, including names, dates and places necessary for complete understanding of the grievance; a listing of the provisions of this Agreement which are alleged to have been violated, misapplied or misinterpreted; a listing of the specific action requested of the District which will remedy the grievance. The immediate supervisor or designee shall meet with the grievant within five (5) work days. The disposition of the grievance shall be indicated in writing within five (5) work days of the meeting, with copies to the grievant and the Association. If the immediate supervisor or designee does not respond within the above time limits, the grievant may proceed to the next level.
