Fluctuations. In the event of a reduction of work on a team where a team member is being cancelled on a regular basis, the Employer agrees that such team member may be offered the opportunity to be reassigned to another team where there is a more junior nurse who is working. This process will go into effect when any nurse on any team has been without work for seven (7) consecutive days or has received four (4) cancellations in a bi-weekly period. This reassignment will be considered temporary. Should the work load return to its previous level on her original team the nurse will return to her previous team.

Fluctuations. In the event any Letter of Credit or other Obligations are at any time denominated in a currency other than Dollars, then, not later than 1:00 p.m. (Boston time) on the last Business Day of each month with respect to such Obligations (the “Calculation Date”), and at such other times as shall be determined by the Lender in its sole discretion, the Lender shall determine the Dollar Equivalent as of such date of such Obligations. The Dollar Equivalent so determined shall become effective on the first Business Day immediately following such determination (a “Reset Date”) and shall remain effective until the next succeeding Reset Date. The Lender shall use its reasonable efforts to provide the Borrowers with notice of such Reset Date and the Dollar Equivalent determined pursuant to the preceding sentence. Without limitation of any of Borrower’s other obligations hereunder, Borrower shall immediately repay any outstanding Obligations if the aggregate amount of the Obligations exceeds the Revolving Credit Ceiling after any Reset Date.
Fluctuations. Where the cost to SILVERSANDS of undertaking the supply has increased for whatever reason since the date of quotation for the supply (or in the absence of a quotation since the date when the price for the supply was agreed) SILVERSANDS shall be entitled by notice in writing to the CLIENT to increase its price to cover such increase in cost. In addition (without limiting the foregoing):- • the cost to SILVERSANDS of undertaking the supply shall be deemed expressly to include the cost of labour together with the cost of products; • if the CLIENT shall require special testing facilities in the presence of SILVERSANDS or its representatives or on SILVERSANDS’ premises any additional expense shall be borne by the CLIENT; • SILVERSANDS business includes the supply of goods and materials from outside the United Kingdom and any increase in cost due to devaluation of currencies or increase in any tax levy or impost will be passed on to the CLIENT, SILVERSANDS giving details of such increase in writing.

Fluctuations. Electric Service must not be used by the Customer in such a manner as to cause unusual fluctuations or disturbances in the Cooperative’s delivery system. Should such fluctuation or disturbance be caused by the Customer the Cooperative may discontinue service to the Customer causing the fluctuation or disturbance or require the Customer to modify the installation and/or install approved controlling devices. The Electric Supplier hereby recognizes the potential for service discontinuance under this provision and waives any claim for lost profits or similar damages relating to such discontinuance.
