FLAGRANT VIOLATIONS Sample Clauses
The "Flagrant Violations" clause defines and addresses particularly severe or egregious breaches of contract terms. In practice, this clause typically outlines what constitutes a flagrant violation—such as willful misconduct, gross negligence, or repeated non-compliance—and may specify heightened consequences or remedies, like immediate termination or increased damages, for such breaches. Its core function is to deter serious misconduct and provide a clear mechanism for responding to the most serious contractual violations, thereby protecting the interests of the non-breaching party.
FLAGRANT VIOLATIONS. Where a signatory has been found in violation of two significant violations within a twelve (12) month period (including, but not limited to failure to pay proper pay and fringe benefit contributions, improper hiring procedure, and violations of the overtime clause) covered by this Agreement, and has been subject to damages, other than delinquency charges therefore, such signatory shall be deemed to be a flagrant violator. In such instances, the Employer shall be required to register all jobs with the LMCC prior to starting for a period of one (1) year, and the Painters and Allied Trades District Council No. 36 shall place a ▇▇▇▇▇▇▇ on each job being performed by the Employer for a period of one (1) year. Said ▇▇▇▇▇▇▇ shall be the first man on the job (▇▇▇▇▇▇▇ excluded), and in such instances, the LMCC shall impose additional damages against the violator.
FLAGRANT VIOLATIONS. Examples of flagrant violations include, but are not limited to, charging for FSP service, theft, being under the influence of drugs or alcohol, possession of firearms or illegal weapons, tampering or interfering with tracking hardware or software, solicitation or receiving and keeping tips and other gratuities, use of dedicated FSP trucks under contract for other purposes, recommending or providing secondary tow or repair services, etc.
FLAGRANT VIOLATIONS. At a minimum, flagrant violations shall result in a fine to the Contractor of $500 to $2,500 for each and every occurrence as determined by PCTPA. Depending on the severity of the flagrant violation(s), PCTPA may terminate the Agreement.
