Fixed Term Appointments. A) Fixed-term Faculty Fixed-term faculty are appointed at a rank of Instructor or higher. The duties of a fixed-term faculty member, whether in a full-time or a part-time assignment, consists largely of instruction. A full-time assignment from which no service or scholarship is expected shall consist of 45 load hours. The teaching load of fixed term appointments for which additional effort for scholarship or service is required shall be less than 45 hours, pro-rated commensurate with the level of non-teaching activities assigned. The pay and FTE for fixed-term faculty appointed at ranks higher than Instructor shall be comparable to those for appointment at the corresponding, regular faculty ranks. Once appointed at rank or promoted, they shall not be reduced. Fixed-term appointments are normally one year or less, and are individually negotiated as to terms. Fixed-term faculty may be renewed depending on the needs or the University. In some cases, fixed-term faculty may be contracted for multiple-year contracts dependent on the needs of the University. Such appointments specify the beginning and ending date of the employment period in the Notice of Appointment. Beyond the ending date of this period, there is no commitment for continued employment and timely notice is not required. Fixed-term appointments for one year of less may be renewed subject to such factors as merit evaluation, program needs and availability of funds. Those individuals on fixed-term appointments are not eligible for indefinite tenure but may be considered for tenure-related positions when vacancies occur. Such appointments specify the beginning and ending date of the employment period in the Notice of Appointment and may be made in either administrative or management areas. Contract recommendations will be made by Deans of the Colleges in instructional areas and by unit administrators in other employment areas. Renewability of a contract shall be specified in the Notice of Appointment. (See Section 2(1) below, Professor, Associate Professor, Assistant Professor, and Librarians). Visiting faculty are not eligible for tenure, nor does service in this rank normally count toward the tenure probationary period upon promotion to a tenure-track rank. Fixed Term Appointments. AFixed term appointments shall be for a specified period of time. Fixed term appointments shall only be entered into for the following reasons: a) Fixed-term Faculty Fixed-term faculty are appointed at to relieve for a rank substantive position where the incumbent is on approved leave; b) to fill a vacancy pending permanent (tenured) appointment; c) emergency relief positions; d) to provide for a secondment or to provide cover as a result of Instructor or highersecondment; e) to undertake a finite task for a period not exceeding two years; f) to match a period of contractual/targeted funding (e.g. for research) where the renewal of such funding is not subject to a regular renewal cycle; g) to trial a new course for a period not exceeding two years. h) to provide for increases in enrolments in particular subject areas in excess of planned (budgeted) increases. i) to give effect to an employee’s retirement plans. j) To provide for staff employed under the Graduate Assistantship Awards for Masters Research. Regular full and part-time Fixed-Term Faculty Fixed-term are not eligible for tenure, nor does service in accordance with AUT policy. (e) The options under the surplus staffing provisions of this rank normally count toward the tenure probationary period upon promotion to a tenure-track rank. Instructor appointments Agreement shall not include any right to permanent or continuous employmentapply at the conclusion of the specified term of employment when fixed term appointments have been made for one of the purposes above. (f) If, at the expiry of a fixed term appointment the genuine reason for the expiry no longer exists and the work is ongoing, the provisions of clause 3.2.1 shall not create any manner apply and the incumbent will be confirmed into a permanent position. (g) Confirmation of legal right, interest, or expectancy of renewal or any other type of appointment, the incumbent is conditional upon satisfactory performance as defined through the monitoring and shall be subject to annual renewal by review process as prescribed in clause 3.2.3(c) Note ‘fixed term’ has the Universitysame meaning as ‘limited tenure’.
