Fixed Costs; FPDE Charge Installments. Subject to Sections ------------------------------------- 4.2(a) and 4.3(a), annual amounts due for Fixed Costs and the annual amount of the FPDE Charge shall be payable in 12 equal monthly installments. For the first six (6) months of the Initial Term, DMPC will invoice EPI quarterly in arrears for monthly installments of Fixed Costs and FPDE Charge. Thereafter, DMPC will invoice EPI monthly in advance on the first day of each month for installments of Fixed Costs and FPDE Charge.

  • Delinquent Payment; Handling Charges All past due payments required of Tenant hereunder shall bear interest from the date due until paid at the lesser of eighteen percent per annum or the maximum lawful rate of interest (such lesser amount is referred to herein as the "Default Rate"); additionally, Landlord, in addition to all other rights and remedies available to it, may charge Tenant a fee equal to five percent of the delinquent payment to reimburse Landlord for its cost and inconvenience incurred as a consequence of Tenant's delinquency.
