First Class. It is an express condition of this Permit that Permittee conduct the Permitted Uses under this Permit in a first class, business like, safe, efficient, courteous and accommodating manner, in accordance with all of the requirements of this Permit. Port has foremost in mind providing the air traveler and the public with facilities and service of first class quality, commensurate with the trade accustomed to using facilities of this kind. Permittee shall ensure that a decor is established and maintained substantially in accordance with Port design and facility plans, that the Concession Unit is maintained and operated in a first-class manner and that at all times the Assigned Space is kept in a safe, clean, orderly and inviting condition, satisfactory to Port. To accomplish these desires, Permittee must periodically review or cause to be reviewed, operations of the Concession Unit operated by Permittee at the Airport.
First Class. (i) For purposes of describing the City's obligation to maintain and repair the DPAC, or to construct Improvements to the DPAC, "First Class" shall mean maintained and equipped or constructed in a manner consistent with other United States performing arts venues that are generally recognized in the industry as being first class venues capable of providing patrons with a quality experience in all material respects. (ii) For purposes of describing Operator's obligation to maintain and operate the DPAC, "First Class" shall mean maintained and operated in a manner consistent with other United States performing arts venues that are generally recognized in the industry as being first class venues capable of providing patrons with a quality experience in all material respects.
First Class. The Concessionaire shall maintain and operate the Concession in an orderly, proper, and first-class manner, which, in the sole judgment of State, does not annoy or disturb, or is not offensive to others at the Airport. The Concessionaire shall not solicit Concession business in any manner which would prove offensive to the public or which may result in deception or disguise of all actual costs or charges relating to the rental of Automobiles anywhere at the Airport except in a proper manner upon the Premises and by means of advertising elsewhere at the Airport first approved in writing by State.
First Class. A manner of operation of the Concession, a standard of quality of materials and construction, a standard of quality of goods and services, and sustainability practices creating a high performing Concession contributing to a four (4) to five (5) star rating in food and beverage, retail, consumer services, and airport staff from the SKYTRAX rating service or a similar standard chosen by the City.
First Class. All parties expressly acknowledge and agree that the Amended Leased Property shall be utilized and maintained and the Private Improvements and Ancillary Improvements shall be constructed, operated and maintained in a first-class manner. "First-Class", as used in this Amended and Restated Lease, shall mean safe, secure, sanitary and well maintained and operated; and will meet or exceed the requirements as set forth in applicable federal, local and state law.
First Class. A manner of operation of the Concessions, a standard of quality of materials and construction, a standard of quality of good and services, and sustainability practices above or comparable to those of upscale shopping centers in the Denver-Aurora Statistical Area and similar high-quality airport and non-airport service establishments.

  • Class All REMIC I Regular Interests or the Class R-1 Residual Interest having the same priority and rights to payments on the Mortgage Loans from the REMIC I Available Distribution Amount, all REMIC II Regular Interests or the Class R-2 Residual Interest having the same priority and rights to payments on the REMIC I Regular Interests from the REMIC II Available Distribution Amount, and all REMIC III Regular Interests or the Class R-3 Residual Interest having the same priority and rights to payments on the REMIC II Regular Interests from the REMIC III Available Distribution Amount, as applicable, which REMIC I Regular Interests, REMIC II Regular Interests, REMIC III Regular Interests and Class R Residual Interests, as applicable, shall be designated as a separate Class, and which, in the case of the Certificates (including the Class R Certificates representing ownership of the Class R Residual Interests), shall be set forth in the applicable forms of Certificates attached hereto as Exhibits A and B. Each Class of REMIC I Regular Interests and the Class R-1 Residual Interest shall be entitled to receive the amounts allocated to such Class pursuant to the definition of "REMIC I Distribution Amount" only to the extent of the REMIC I Available Distribution Amount for such Distribution Date remaining after distributions in accordance with prior clauses of the definition of "REMIC I Distribution Amount," each Class of REMIC II Regular Interests and the Class R-2 Residual Interest shall be entitled to receive the amounts allocated to such Class pursuant to the definition of "REMIC II Distribution Amount" only to the extent of the REMIC II Available Distribution Amount for such Distribution Date remaining after distributions in accordance with prior clauses of the definition of "REMIC II Distribution Amount" and each Class of REMIC III Regular Interests and the Class R-3 Residual Interest shall be entitled to receive the amounts allocated to such Class pursuant to the definition of "REMIC III Distribution Amount" only to the extent of the REMIC III Available Distribution Amount for such Distribution Date remaining after distributions in accordance with prior clauses of the definition of "REMIC III Distribution Amount."

  • Settlement Class For purposes of this Settlement Agreement only, the Parties stipulate to certification of the following Settlement Class: All current and former non-exempt employees who worked for Defendant in California from October 20, 2016, through the earlier of the date of preliminary approval or August 2, 2021 . Defendant has represented that there are approximately 27 Class Members who worked approximately 2,100 workweeks during the Class Period. The Parties agree that certification for the purpose of settlement is not an admission that class certification is proper under the Federal Rules of Civil Procedure or the California Code of Civil Procedure. If for any reason this Settlement Agreement is not approved or is terminated, in whole or in part, this conditional agreement to class certification will be inadmissible and will have no effect in this matter or in any claims brought on the same or similar allegations, and the Parties shall revert to the respective positions they held prior to entering into the Settlement Agreement.

  • Postal Service The parties may designate substitute addresses where or persons to whom notices are to be mailed or delivered. However, these substitutions will not become effective until actual receipt of written notification.

  • Work Out of Class When an employee is expressly assigned to perform substantially all of the duties of a position allocated to a different class that is temporarily unoccupied and the work-out-of-class assignment exceeds ten (10) consecutive work days in duration, the employee shall be paid for all such hours at the employee's current salary when assigned to work in a class which is a transfer or demotion. For a class which is a promotion, an employee shall receive an increase to the minimum rate of the new class or at least one (1) step higher than the employee's current salary, whichever is greater. If an employee is assigned to work out of class but does not meet the ten (10) consecutive work day standard, and within five (5) working days the employee is subsequently assigned to work out of class to the same assignment, the previous time served on work out of class will count towards meeting the ten (10) consecutive work day standard. When an employee is assigned to serve in a class for which the employee is on a layoff list, the employee shall be paid as provided above or the maximum step previously achieved by the employee, whichever is greater. If the Appointing Authority determines to make a work-out-of-class assignment of six (6) or more consecutive months to a higher class represented by the Union, the Appointing Authority shall appoint the most senior capable and available employee among or within classes and among or within work areas as determined by the Appointing Authority.

  • Postage Postage for mailing of dividends, proxies, Fund reports and other mailings to all shareholder accounts shall be advanced to the Transfer Agent by the Fund at least seven (7) days prior to the mailing date of such materials.

  • SIMPLE Class The Manager will apply an equivalent waiver or reimbursement, in an equal number of basis points waived for Class A Shares.

  • Working Out of Class Section 1 Whenever an employee is requested to perform the tasks of a higher graded position that employee shall receive the rate of pay of that higher graded position or five percent (5%) above his/her regular rate of pay if the rate of pay for the higher graded position is less than five percent (5%) over and above that employee's regular rate of pay and his/her regular position whichever is greater for each and every hour worked in any higher grade during that contract year.
