Common use of File Clause in Contracts

File. An employee shall have the right, upon request, to review the contents of his personnel file and to receive one (1) copy at Board expense of any documents contained therein. An employee shall be entitled to have a representative of the Association accompany him during such review. At least once every ten (10) years, an employee shall have the right to indicate those documents and/or other materials in his file which he believes to be obsolete or otherwise inappropriate to retain. Said documents shall be reviewed by the Superintendent or his designee and if, in fact, they are obsolete or otherwise inappropriate to retain, they shall be destroyed.

Disputes over the retention of said documents may be processed through the grievance procedure, commencing at the appropriate level (generally two).
