Common use of Fees Generally Clause in Contracts

Fees Generally. In consideration of the Service or Item provided to Buyer by Supplier under this Agreement, Supplier shall be entitled to payment by Buyer of the mutually agreed-upon Fees set forth in the applicable SOW for the respective Service or Item, pursuant to the terms of this FEES section (Section 5.1 et seq.). Except as expressly set forth in this Agreement, under no circumstances shall Buyer have any obligation to pay Supplier, or shall Supplier be entitled to recover from Buyer, any amount greater than the applicable Fees for the provision of any Service or Item under this Agreement.
