Family and Medical Leave Act Policy and Procedures. The Family and Medical Leave Act (FMLA) provides an entitlement of up to 12 weeks of job- protected, unpaid leave during any 12-month period to eligible, covered employees. Employees may be entitled to more than 12 weeks of leave in certain circumstances. More information can be found at the Department of Labor Website. For any leave which qualifies under FMLA, the employee will be required to exhaust all applicable paid leave prior to the approval of unpaid leave. The College calculates the "12 month period" using a "rolling" 12-month period measured backward from the date an employee uses any FMLA leave. The provisions of State and Federal Law shall prevail for all aspects of military leave under the FMLA, including requests for and return from such leave.
