Failure to Exercise a Right. The Employer's failure to exercise such rights in a particular way shall not be deemed a waiver of the right to exercise such rights in other ways not in conflict with the express terms of this Agreement.
Failure to Exercise a Right. Supplier's failure to exercise a right does not represent any waiver of its right to take action against Influencer or any third party for breach of commitments undertaken. The Supplier therefore reserves the right to enforce its rights in any case, within the terms granted.
