Common use of Failure Points Clause in Contracts

Failure Points. (a) In each Contract Month, Project Co shall measure the performance of the Maintenance Services, and based on the performance of the Maintenance Services in the applicable Contract Month, Failure Points may be awarded in respect of the Maintenance Services in accordance with the Payment Mechanism.
