Common use of Fact Finding Hearing and Report Clause in Contracts

Fact Finding Hearing and Report. The advisory fact finder shall have authority to schedule and conduct hearings for the purpose of hearing testimony and gathering facts relevant to the impasse; and upon completion of such hearings, shall submit written findings of fact, reasoning and recommendations for resolution of the dispute and shall cause the same to be served on the parties via email and regular U.S. mail. The report shall be deemed accepted unless, within seven (7) days of service, one or both parties reject the report by a vote of three fifths (3/5) of eligible SHTA-ST members or Board members. In the event the report is rejected, said report may be made public by either party. The costs for the fact finder and of holding the fact finding hearing shall be shared equally by the Board and the Association.
