The Facsimile Subscriptions clause defines the acceptance of contract documents or subscription agreements that are transmitted via fax as legally binding. Facsimile Subscriptions. The Company shall be entitled to rely on delivery by facsimile of an executed copy of this subscription agreement and acceptance by the Company of that delivery shall be legally effective to create a valid and binding agreement between the Subscriber and the Company in accordance with the terms of this subscription agreement.

The Fund shall be entitled to rely on delivery by facsimile machine or other method of electronic delivery of an executed copy of this Subscription Agreement, including the completed Schedules hereto, and acceptance by the Fund of such facsimile or electronic copy shall be legally effective to create a valid and binding agreement between the Purchaser and the Fund in accordance with the terms hereof.
