The Charge or staff nurse determines who is scheduled to work the next shift in the department. 2. If there are more nurses scheduled than are needed, the charge or staff nurse will check the stay home chart for the most recent on call/stay home/or accumulated hours totaling a full shift. The Charge or staff nurse will then determine who will stay home using the following sequence: A. Non guaranteed Agency nurses, unless Medical Center determines in specific situations that it is in the best interest of patient care to use B below ahead of A. B. Nurses whose work would be payable at overtime or other premium rates, including for extra shifts. C. Volunteer request to stay home or be placed on call. Lists of requested voluntary Low Census are maintained electronically indicating Low Census, and the nurse must designate his or her preference related to ▇▇▇▇▇▇▇ at the time the nurse places his or her name on the list. Such preference will be considered by the Medical Center in determining which nurse will be given the Low Census, based on the determination as to the standby needs for the department (e.g., with or without standby). Where multiple requests are received for the same status of voluntary low census (e.g., with or without standby), the earliest request(s) will be given preference and the order will be viewable by nurses on- line, provided that a nurse on the same department is qualified to perform the work of the nurse given the time off. 1. The parties acknowledge that the Medical Center will make its best effort to select accurately among volunteers for low census. The parties agree, however, that no grievance may be filed about disputes between two or more volunteers for low census. 2. Extra Shift Premium. 11 1. Full-time and part-time nurses will be paid at one and one-half (1 1/2) 12 times their regular straight-time rate of pay for all hours worked above the 13 nurse's regularly scheduled FTE except when there is a change of 14 A. schedule agreed upon by the Medical Center and nurse. A nurse working 15 a . 5 FTE or .6 FTE must work one extra shift at straight time before 16 becoming eligible for extra shift premium on subsequent extra shifts. 17 Hours worked in determining eligibility for this premium will not include 18 hours worked as a result of trades; at the request of other nurses; or being 19 called back to work while on standby. This section will apply only if the 20 nurse also works all of his/her scheduled shifts in the same pay period, 21 other than such shifts that were not worked because of a low census day 22 or because they had previously been scheduled as earned leave time off. 23 This premium will not be paid for any un-worked hours. This section 24 replaces all other premiums for working extra or unscheduled shifts that 25 may have been in existence before this section's effective date. 26 Once a nurse agrees to work an extra shift, the nurse is committed to 27 working that shift. If a nurse calls in unable to work during a pay period in 28 which the nurse has signed up for extra shift(s), the extra shift differential 29 will be waived for the corresponding number of extra shifts that the nurse 30 misses. Further, a nurse is required to use accrued PTO for the missed 31 shift. 1 2. There will be no pyramiding of hours worked under the terms of this letter 2 of agreement. (Example: If a nurse is paid the premium under this 3 section, the hours so paid will not be counted toward the computation of 4 weekly overtime.) No hour will be eligible for the payment of two such 5 premiums. 6 3. An apparently eligible nurse will be paid a the extra shift premium of nineteen dollars ($19.00) per hour 15 for all the 7 payroll period covering the hours worked in excess of worked. If it is subsequently determined 8 that the number of nurse was not eligible, the one-half premium amount will be 9 deducted from the nurse's regularly 16 scheduled hours pay for a subsequent payroll period. 10 4. Thereafter, all qualified nurses in the bargaining unit 23 may sign up. A nurse may sign up during for extra shifts; however, the Medical 24 Center may limit nurses to one hundred eight (108) hours in a pay period. 25 If the Medical Center is concerned about patient care and safety, the 26 Medical Center reserves the right to limit the number of extra shifts a 27 nurse may work. 28 6. If two (2) or more nurses sign up for the same extra shift in the first seven 29 (7) days that the extra shifts are posted, the senior nurse prevails. 30 7. Per Diem nurses are not eligible for the extra shift premium. 1 8. Nurses who work 21 week in which they have already worked thirty-six an extra shift on Christmas Eve, Christmas Day, New 2 Years Day and Thanksgiving will be paid two (362) hours.
