Expungement. In taking disciplinary action against an employee, the employer will not consider or rely upon any prior disciplinary action taken against the employee more than three (3) years before the occurrence upon which the current disciplinary action is based. If an employee works without committing a disciplinary offense for one (1) calendar year from the date of his/her last offense, the employee will receive a rollback of one (1) prior disciplinary step.
