Existing Facilities Capacity. The Parties agree that Landlord’s development on the Benefited Property may require the use of the Facilities, and Tenant agrees to make such Facilities available to Landlord to provide Landlord’s Reserved Water Rights on a non-discriminatory basis, subject to Shortfall and Priority limitations set forth within Subsection 13.4(f).
