The "Existing Construction" clause defines the rights and responsibilities of the parties regarding any structures, improvements, or features already present on the property at the time of contract execution. Typically, this clause clarifies whether the seller is required to make repairs, maintain, or remove existing buildings, and may specify which items are included or excluded from the sale. Its core practical function is to prevent disputes by clearly outlining the treatment of existing property features, ensuring both parties have a mutual understanding of what is being transferred and in what condition.
Existing Construction. Do not disturb existing construction beyond the extent indicated or necessary for installation of new construction. Provide temporary shoring and bracing for support of building components to prevent settlement or other movement. Provide protective measures to control accumulation and migration of dust and dirt in all work areas. Remove dust, dirt, and debris from work areas daily.
Existing Construction. (a) Back yards and Side yards. Underground cable drops shall be buried at a minimum depth of twelve (12) inches when in rights-of-way and utility easements except as otherwise required herein. Underground cable drops shall be buried at a minimum depth of twenty-four (24) inches when in rights-of-way and utility easements for a distance of more than twenty (20) feet.
Existing Construction a. Steel expansion anchors not less than 1/4 inch bolt size and not less than 1-1/8 inch embedment.
b. Power set fasteners not less than 1/4 inch diameter with depth of penetration not less than 3 inches.
c. Use vibration and shock resistant anchors and fasteners for attaching to concrete ceilings.
Existing Construction. Any existing Joint Use construction of the parties hereto which does not conform to the specifications mentioned in Article 3 shall be brought into conformity therewith as soon as practicable. To the extent such construction is compliant with the specifications in effective at the time of installation, neither party will be required to retrofit such existing, compliant attachments and at all times NESC grandfathering rules will apply. When such existing construction shall have been brought into conformity with said specification, it shall at all times thereafter be maintained as provided in Sections 9.01 and 9.09 of this Article 9.
