Common use of Exclusion Lists Screening Clause in Contracts

Exclusion Lists Screening. HemaCare shall screen all of its current and prospective legal entities, officers, directors, and employees directly assigned to work for Xxxxx (“Screened Persons”) against (a) the United States Department of Health and Human Services/Office of Inspector General List of Excluded Individuals/Entities (available through the Internet at xxxx://xxx.xxx.xxx.xxx), and (b) the General Services Administration's List of Parties Excluded from Federal Programs (available through the Internet at xxxx://xxx.xxxx.xxx) (collectively, the 'Exclusion Lists”) to ensure that none of the Screened Persons (y) are currently excluded, debarred, suspended, or otherwise ineligible to participate in Federal healthcare programs or in Federal procurement or nonprocurement programs, or (z) have been convicted of a criminal offense that falls within the ambit of 42 U,S.C. § 1320a-7(a), but have not yet been excluded, debarred, suspended, or otherwise declared ineligible (each, an “Ineligible Person”). If, at any time during the term of this Agreement any Screened Person becomes an Ineligible Person or proposed to be an Ineligible Person, HemaCare shall immediately notify Hospital of the same. Screened Persons shall not include any employee, contractor or agent who is not providing services under this Agreement.

HemaCare SASH shall screen all of its current and prospective owners, legal entities, officers, directors, employees, contractors, and employees directly assigned to work for Xxxxx agents (“Screened Persons”) ), if any, against (a) the United States Department of Health and Human Services/Office of Inspector General List of Excluded Individuals/Entities (available through the Internet at xxxx://xxx.xxx.xxx.xxx), and (b) the General Services Administration's List of Parties Excluded from Federal Programs ’s System for Award Management (available through the Internet at xxxx://xxx.xxxx.xxxxxxx://xxx.xxx.gov), and (c) any applicable state healthcare exclusion list (collectively, the '“Exclusion Lists”) to ensure that none of the Screened Persons (y) are currently excluded, debarred, suspended, or otherwise ineligible to participate in Federal healthcare programs or in Federal procurement or nonprocurement non-procurement programs, or (z) have been convicted of a criminal offense that falls within the ambit of 42 U,S.C. U.S.C. § 1320a-7(a), but have not yet been excluded, debarred, suspended, or otherwise declared ineligible (each, an “Ineligible Person”). If, at any time during the term of this Agreement Contract any Screened Person becomes an Ineligible Person or proposed to be an Ineligible Person, HemaCare SASH shall immediately notify Hospital of the same. Screened Persons shall not include any employee, contractor or agent who is not providing services under this AgreementContract.

HemaCare Tenant shall screen all of its current and prospective owners, legal entities, officers, directors, employees, contractors, and employees directly assigned to work for Xxxxx agents (“Screened Persons”) ), if any, against (a) the United States Department of Health and Human Services/Office of Inspector General List of Excluded Individuals/Entities (available through the Internet at xxxx://xxx.xxx.xxx.xxxhtt;://xxx.xxx.xxx.xxx), and (b) the General Services Administration's ’s List of Parties Excluded from Federal Programs (available through the Internet at xxxx://xxx.xxxx.xxx) (collectively, the '“Exclusion Lists”) to ensure that none of the Screened Persons (y) are currently excluded, debarred, suspended, or otherwise ineligible to participate in Federal healthcare programs or in Federal procurement or nonprocurement programs, or (z) have been convicted of a criminal offense that falls within the ambit of 42 U,S.C. U.S.C. § 1320a-7(a), but have not yet been excluded, debarred, suspended, or otherwise declared ineligible (each, an “Ineligible Person”). If, at any time during the term of this Agreement Lease any Screened Person becomes an Ineligible Person or proposed to be an Ineligible Person, HemaCare Tenant shall immediately notify Hospital Landlord of the same. Screened Persons shall not include any employee, contractor or agent who is not providing services to Landlord under this AgreementLease.

HemaCare School shall screen all Program Participants and all of its current and prospective owners, legal entities, officers, directors, employees, contractors, and employees directly assigned to work for Xxxxx agents (“Screened Persons”) against (a) the United States Department of Health and Human Services/Office of Inspector General List of Excluded Individuals/Entities (available through the Internet at xxxx://xxx.xxx.xxx.xxx), and (b) the General Services Administration's ’s List of Parties Excluded from Federal Programs (available through the Internet at xxxx://xxx.xxxx.xxx) (collectively, the '“Exclusion Lists”) to ensure that none of the Screened Persons (y) are currently excluded, debarred, suspended, or otherwise ineligible to participate in Federal healthcare programs or in Federal procurement or nonprocurement programs, or (z) have been convicted of a criminal offense that falls within the ambit of 42 U,S.C. U.S.C. § 1320a-7(al 320a- 7(a), but have not yet been excluded, debarred, suspended, or otherwise declared ineligible (each, an “"Ineligible Person”"). If, at any time during the term of this t his Agreement any Screened Person becomes an Ineligible Person or proposed to be an Ineligible Person, HemaCare College shall immediately notify Hospital of the same. Screened Persons shall not include any employee, contractor or agent who is not providing services under this Agreement.
