Common use of Exception to Obligation Clause in Contracts

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or ICS to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or ICS; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.
