Common use of Exception to Obligation Clause in Contracts

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or Pinnacle to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or Pinnacle; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or Pinnacle Cbeyond to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or PinnacleCbeyond; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Notwithstanding the foregoing, there will be no obligation on BellSouth or Pinnacle Community to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or PinnacleCommunity; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Notwithstanding the foregoing, there will be no obligation on BellSouth or Pinnacle Utilicore to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or PinnacleUtilicore; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.confidential.‌

Notwithstanding the foregoing, there will be no obligation on BellSouth or Pinnacle ALLIANCE to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or PinnacleALLIANCE; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.confidential.‌
