Common use of Evergreen Clause Clause in Contracts

Evergreen Clause. If, on the expiration date, the parties have not yet entered into a new agreement relating to time periods after that date, then the terms and provisions of this Agreement shall nonetheless remain in full force and effect until the earlier of (i) the date a new agreement is entered into by the parties, or (ii) two (2) calendar years after the expiration date. This agreement shall remain in effect during any such period of negotiations.
