The ESA clause, or End-User Software Agreement, defines the terms and conditions under which software is licensed to the end user. ESA. ESA will review the request and verify the accuracy of the salary data, taking into consideration the factors that create compaction, and determine whether there is an insufficient difference in compensation between the positions under review. ESA will confer with the Department and develop a final recommendation. ESA will send CEMA the findings and recommendation(s) and the basis for its findings. CEMA will have ten (10) County business days to review and request a meet and confer with the County over the results of its review. CEMA will provide the findings and recommendations to the employee. If ESA finds that the position may not be appropriately classified, the employee will complete a Position Description Questionnaire and the position will be studied. ESA’s findings as a result of the study will be posted to CEMA. CEMA will have ten (10) County business days to review and request to meet and confer with the County over the results of the study.
ESA. To Seller’s knowledge, there are no (i) endangered or threatened species (as defined or listed under federal law) nor any nesting site(s) or habitat of or waterways containing any such species located on or proximate to the Timberlands, or (ii) areas of the Timberlands within any “owl circles,” which would materially and adversely affect the harvesting of the timber on the Timberlands.
ESA. No Seller is aware of any material breach or default, or any potential material breach or default, by the Company or any of its Affiliates under or pursuant to the Exhibitor Services Agreement between the Company and AMC Multi-Cinema, dated as of February 13, 2007 (the “ESA” ).
ESA. K.E. is obliged to provide to NETHOLD any element or information of its disposition that could assist the better promotion of the teams and of the championship in general.

Unlisted parts will be submitted to the PCB and Parts Assurance Engineering for the selection and approval process.
3.5.1 Program Approved Parts List (PAPL) The PAPL is program specific listing of program approved/authorized parts. The PAPL contains standard parts selected from the APMPL and other nonstandard parts that are approved for use (pending their successful qualification) by the PCB. The PAPL will provide parts listing of all parts, including subcontractor supplied parts, for a specific program/spacecraft. ESA. Category lists for ESA will be further defined as follows: Communication Disorder Specialist; Occupational/Physical Therapist; Psychologist; School Nurses. A member shall be placed in categories for which she or he is qualified based upon a valid Washington teaching certificate (K-12, elementary, or secondary). Additionally, members will be assigned to categories using one or more of these criteria:
1. Endorsement for a specific subject matter or grade level.
ESA. The Electric Services Agreement with respect to the Project is in full force and effect, all conditions precedent required to receive services have been satisfied, including but not limited to North Dakota Public Service Commission approvals, and to the Loan Parties’ knowledge, Montana-Dakota Utilities Co. will be able to satisfy the Borrower and/or its applicable Affiliate’s service delivery obligations under all of its management service agreements with crypto mining customers and the potential lease agreement outlined in letters of intent with respect to the Project.
ESA. Execution of the ESA with all approved exhibits attached, including the fully executed Construction Agreement.
ESA. The Parties intend to negotiate an ESA under which the ESCO shall complete design, if necessary, install and implement ECMs which the Parties have agreed to and provide certain maintenance and monitoring services. However, nothing in this Agreement should be construed as an obligation on any of the Parties to execute such an ESA. The terms and provisions of such an ESA shall be set forth in a separate agreement. In addition to the above requirements, ESCO shall provide actual documented expenditures for work/deliverables on a monthly basis, including ESCO and ESCO subconsultant(s)/subcontractor(s) costs for University review/approval. (NOTE: “subcontractor” is understood to be interchangeable with the term “subconsultant” throughout this agreement with the exception of Prevailing Wage references.)
