Common use of Equipment Performance Clause in Contracts

Equipment Performance. Equipment maintenance If issues of non-compliance are identified during County’s monitoring, the County may provide a written report to the Contractor following the monitoring visit. When issues of non-compliance are identified in the monitoring report, a written Corrective Action Plan (CAP) will be required of the Contractor. The CAP is to be submitted to the County’s Contract Manager within ten (10) days of receipt of the monitoring report. If necessary, a follow-up monitoring visit will be scheduled by the Contract Manager, and will occur within thirty (30) days of the original monitoring visit at which time full compliance must be met. Failure to correct deficiencies after thirty (30) days of receipt of a written monitoring report notating the deficiencies may result in County’s determination of breach of contract and termination of this Agreement. The County reserves the right for any County staff to make scheduled or unscheduled, announced or unannounced visits to the Contractor’s place of business.
