Equal Benefits Ordinance. In accordance with City’s Equal Benefits Ordinance, codified in SDMC sections 22.4301-22.4308 (“EBO”), Manager shall provide and maintain equal benefits, as defined in SDMC section 22.4302 during the Term. Failure of Manager to maintain equal benefits consistent with the EBO is an Event of Default by Manager (SDMC 22.4304(e)). Manager shall notify its employees of the equal benefits policy at the time of hire and during open enrollment periods and must post a copy of the following statement in an area frequented by its employees: “During the performance of a contract with City of San Diego, this employer will provide equal benefits to its employees with spouses and its employees with domestic partners.”
