Energy Audit Report. The Energy Audit Report prepared by the ESCO and accepted by the University contains specific recommendations and documentation, including design documentation, concerning the ECMs, systems and services to be provided at the Facility and is incorporated herein by reference. Notwithstanding, the provisions of this Agreement and the Schedules referenced in Section 3.5 shall govern in the event of any inconsistencies between the Energy Audit Report and the provisions of this Agreement.

Notwithstanding, the provisions of this Agreement Agreement, Tthe Schedules and the Schedules Project Documents referenced in Section 3.5 paragraph 3.3 shall govern in the event of any inconsistencies between the Energy Audit Report and the provisions of this Agreement.
