Common use of Employment; Position; Term Clause in Contracts

Employment; Position; Term. The Company and the Executive hereby agree to the Executive’s employment by the Company in the position of Chief Medical Officer (the “Position”). Subject to earlier termination pursuant to the terms of Section 5, the initial term of this Agreement shall be for thirty-six (36) months, beginning May 1, 2010 and ending at 5:00 Mountain Time on April 30, 2013. Beginning on May 1, 2013 and on each May 1st thereafter (any such day being referred to herein as a “Renewal Date”) the term of this Agreement shall be extended automatically for one additional year unless the Company has provided Executive with written notice at least 120 days in advance of the next Renewal Date that the term of this Agreement shall not be so extended.

Beginning on May 1, 2013 and on each May 1st thereafter (any such day being referred to herein as a “Renewal Date”) the term of this Agreement shall be extended automatically for one additional year unless the Company has provided Executive with written notice at least 120 days in advance of the next Renewal Date that the term of this Agreement shall not be so extended.
