EMPLOYMENT OF PERSONNEL/PAYROLL EXPENSES. H.1. Agent shall hire, fire, and discipline all on-site employees (if appropriate), for Association’s benefit and at the request of the Association. All expenses incident to employment of the personnel will be borne by Association as a budgeted expense of the Association. Those expenses are: state and federal unemployment taxes, F.I.C.A., workers’ compensation insurance, bodily injury and property damage liability insurance, as well as payroll administration fees and any benefits included in the employee’s compensation package. Benefits consistent with the employment of quality personnel, such as health insurance, are considered incident to the employment of such personnel and shall be a budgeted expense of Association. All employees will be subject to personnel policies set forth by the Agent. Agent shall charge a 10% burden rate of the gross pay for employing personnel on behalf of the Association. Any non-exempt employee working more than forty (40) hours per week will be paid at time and one-half. There shall be no replacement personnel provided during full-routine periods of paid time off and sick leave.
H.2. The Association recognizes that Agent is obligated to take reasonable measures to protect its employees from harassment. Those measures may include but are not limited to, limiting communications with an Owner or member of the Board of Directors who has displayed abusive behavior toward Agent’s employee(s). The Association understands Agents’ duty to address such harassment and acknowledges that Agent may limit its employee’s communications (telephonic, electronic, or otherwise) with any individual at Agent’s sole discretion. If feasible in such a situation, the Association agrees to take reasonable measures to assist Agent in precluding recurrence of abusive or harassing behavior.
