Eligibility of Group. 1. Client represents and warrants that it: (a) is an employing unit with at least one Eligible Individual in its employment; and (b) engages in business in Hawaii and employs employees who live, work, or reside in Hawaii. HMSA may give special consideration to Eligible Individuals who work and reside out-of-state, but such out-of-state Eligible Individuals shall not be included as Subscribers in the Plan except with advance written consent of HMSA.
