Easements and Restrictions. This Offer is contingent upon Buyer obtaining, within days of acceptance, at 124 (Buyer’s) (Seller’s) (“Buyer’s” if neither is stricken) expense, copies of all public and private easements, covenants and 125 restrictions affecting the Property and a written determination by a qualified independent third party that none of these prohibit or significantly STRIKE ONE 126 delay or increase the costs of the proposed use or development identified at lines 116 to 118. ⬜ APPROVALS: This Offer is contingent upon Buyer obtaining, at (Xxxxx’s) (Seller’s) (“Buyer’s” if neither is stricken) expense, 128 all applicable governmental permits, approvals and licenses, as necessary and appropriate, or the final discretionary action by the granting 129 authority prior to the issuance of such permits, approvals and licenses, for the following items related to Buyer’s proposed use: 130 131 or delivering written notice to Seller if the item(s) cannot be obtained or can only be obtained subject to conditions which significantly increase 132 the cost of Xxxxx’s proposed use, all within days of acceptance of this Offer.
