Duration 2. 01
(1) This agreement shall be in effect on the first day of September, 2008 and continue in force until the 31st day of August, 2012 and shall continue automatically thereafter for annual periods of one year unless either party notifies the other in writing within 90 days prior to the expiration date that they desire to negotiate with a view to renewal, with or without modifications of this agreement, in accordance with the Ontario Labour Relations Act.
(2) Notwithstanding the period of notice cited in (1), either party may notify the other in writing, within the period commencing April 1 prior to the expiration date that it desires to negotiate with a view to renewal, with or without modifications of this Agreement, in accordance with the Ontario Labour Relations Act.
(3) If either party gives notice of its desire to negotiate amendments in accordance with Section (2), the parties shall meet within fifteen (15) working days from the giving of notice to commence negotiations for the renewal of the Agreement in accordance with the Ontario Labour Relations Act.
(4) No changes can be made to this Agreement without the mutual written consent of the parties; nor can any changes be made to this Agreement without submitting the changes for ratification by the parties, as determined by their respective bargaining procedures.
(5) No teacher shall be requested or required to perform the duties of any other teacher or employee of the Board who is engaged in a strike.

(1) It is the sole and exclusive right and obligat ion of the Board to exercise its management functions and trustee responsibilities and to manage the affairs of the Board and to exercise these rights and obligations in a manner consistent with the collective agreement and subject to the provisions of the Ontario Labour Relations Act, the ▇▇▇▇▇▇▇▇▇▇▇▇ ▇▇▇, ▇▇▇▇, and in particular Section 93 thereof, and the Acts and regulations of the Ministry of Education and the Province of Ontario.
(2) A teacher will be considered to be on probation until the teacher:
a) has comp leted two years of employment with the Board, if the teacher has less than one y ear of experience, as a teacher in a secondary school in Ontario before commencement of employment with the Board; or
b) has comp leted one year of employment with the Board, if the teacher has one or more years of experience, as a teacher in a secondary school in Ontario before commencement of employment with the Board.
