Document Disclosures. Business Associate will make available Protected Health Information requested by Covered Entity or an Individual as required to provide an accounting of Disclosures in accordance with 45 C.F.R. § 164.528 and Section 13405(c) of the HITECH Act. Such information shall be provided to Covered Entity, unless Covered Entity directs Business Associate in writing to make the accounting directly to the Individual. Business Associate agrees to document such Disclosures of Protected Health Information and information related to such Disclosures as would be required for Covered Entity to respond to a request by an Individual for an accounting of Disclosures of Protected Health Information in accordance with 45 C.F.R. § 164.528 and Section 13405(c) of the HITECH Act.
