DISTRICT FUNCTIONS. The management and direction of the work force is vested exclusively in the District, subject to the terms of this agreement. All matters not specifically and expressly covered or treated by the language of this agreement may be administered for its duration by the District in accordance with such policy or procedure as from time to time may be determined. A. The Board, on its own behalf and on behalf of the electors of the District, hereby retains and reserves unto itself, without limitations, all powers, rights, authority, duties, and responsibilities conferred upon and invested in it by the laws of the constitution of the state of Oregon, and of the foregoing, the right: 1. To the executive management and administrative control of the school system and its properties and facilities, and the activities of its members during school hours and at school sponsored activities. 2. To the unqualified right to hire all members and subject to provisions of the Law, to determine their qualifications and the conditions of their continued employment, assignment, promotion, transfer, demotion, or their dismissal. 3. To establish grading system and courses of instruction, including special programs, and to provide for athletic, recreational and social events for students all as deemed necessary or advisable by the District. 4. To decide upon the means and methods of instruction, in accordance with member evaluation procedures. Textbooks and other teaching materials, and the use of teaching aides of every kind and nature, will be selected by the Superintendent/Principal and members with District approval. 5. To determine class schedules, and the duties, responsibilities, and assignments of members and other members with respect thereto. 6. The unqualified right to establish the school calendar in accordance to district policy. 7. To determine the services, supplies and equipment necessary to continue its operation and to determine the methods, schedules and standards of operation, the means methods and processes of carrying on the work including automation thereof or changes therein, the institution of new and/or improved methods or changes therein. 8. Adopt reasonable rules and regulations. 9. Determine the financial policies, including all accounting procedures and all matters pertaining to public relations. 10. Determine the size of the management organization, its functions, authority, and amount of supervision and table of organization. 11. Determine the policy affecting the selection, testing or training of members providing such selection shall be based upon lawful criteria. B. Nothing shall restrict the District’s right to contract or subcontract out bargaining unit work and/or work currently being performed by members of the bargaining unit. If the District is planning to contract out any current bargaining unit position, the District will notify the Association and, upon demand made within fourteen (14) days of that notice, will bargain both the impact and decision under ORS 243.698. The exercise of the foregoing powers, rights, authority, duties and responsibilities by the District, shall be limited only by the specific, written terms of this agreement and then only to the extent such terms are in conformance with the Constitution and the laws of the state of Oregon.
