Distribution of Company’s Recovery. In the event of a recovery by the Company of compensatory damages (i.e. non-punitive damages net of legal fees and out of pocket costs of the action) under paragraph 5.2 (Royalty) for a royalty-bearing seed created exercising the Licensed Rights, the Company shall pay to AAFC the applicable royalty rate on infringing sales.   • Distribution of Net Cash Flow Net Cash Flow shall be distributed among the Partners in accordance with their Partnership Percentages at such times and in such amounts as shall be determined by the General Partner.
