DEVELOPER’S RESPONSIBILITY FOR CODE VIOLATIONS. In the event of a violation of City Code relating to use of the Property or failure to fulfill an obligation imposed upon the Developer pursuant to this Development Agreement, the City shall give 24 hours’ notice of such violation in order to allow a cure of such violation, provided however, City need not issue a building or occupancy permit for construction or occupancy on the Property while such a violation is continuing, unless waived by City. The existence of a violation of City Code or the failure to perform or fulfill an obligation required by this Development Agreement shall be determined solely and conclusively by the Delano City Administrator or a designee.
