Developer / Owner Responsibilities a. The Developer shall have full and complete responsibility for the construction, management, and operation of the Project, all at no cost or expense to the City, except as provided otherwise in this Agreement. The Developer shall further have full and complete financial, managerial and legal responsibility and liability associated with personal injury, property damage, contractual and all other types of liability for the Project. The Developer shall cause any and all contractors employed, hired, utilized and/or retained by the Developer to carry reasonable and customary insurance, including general commercial liability insurance, at such limits as may be reasonably required by the City to cover any claim or loss to person(s) or property arising out of said contractor’s construction of the Project. b. If the Project required a Developer Grading Permit, then the Developer shall post security for the Project, in a form acceptable to the City, in an amount equal to the flat fee of Two Hundred Dollars ($200.00 plus Ten Cents ($0.10) per square foot of area disturbed, as shown on the City-approved grading permit plans and cost estimate (collectively, the “Plans”). c. In accordance with City Council Resolution R-32-22, all City permit fees in connection with the Project, except for any security required above, have been waived for the duration of the technical and financial partnership between the City and Chesapeake Bay Trust. d. The Developer shall comply with all City, local, state, and federal laws, regulations, permits, and other requirements applicable to the Project. e. As may be applicable, the Developer shall provide the City with evidence that the Project and any related permits were reviewed and approved by the Critical Area Commission and/or the Maryland Department of the Environment and/or the U.S. Army Corps of Engineers. f. The Developer shall provide the City with evidence that the Project meets all applicable requirements of the Maryland Forest Conservation Act, Annotated Code of Maryland, Natural Resources Article, Title 5, Subtitle 16, as may be amended. g. The Developer shall have full and complete responsibility for surveying the Project area to ensure that the Project is only completed on the Property owned by the Owner. h.   • Scope of Services The specific scope of work for each job shall be determined in advance and in writing between TIPS Member, Member’s design professionals and Vendor. It is permitted for the TIPS Member to provide a general scope description, but the awarded vendor should provide a written scope of work, and if applicable, according to the TIPS Member’s design Professional as part of the proposal. Once the scope of the job is agreed to, the TIPS Member will issue a PO and/or an Agreement or Contract with the Job Order Contract Proposal referenced or as an attachment along with bond and any other special provisions agreed by the TIPS Member. If special terms and conditions other than those covered within this solicitation and awarded Agreements are required, they will be attached to the PO and/or an Agreement or Contract and shall take precedence over those in this base TIPS Vendor Agreement.

  • Scope of Work For the 2022/2023 Grant Period, the Provider will maintain a victim services program that will be available to provide direct services to victims of crime who are identified by the Provider or are presented to the Provider, as specified in the Provider’s 2022/2023 Grant Application as approved by the OAG and incorporated herein by reference.

The Contractor is fully responsible for satisfactory completion of all its subcontracted work.
