Common use of Designation of Smoking Areas Clause in Contracts

Designation of Smoking Areas. Section A. Absent objection from another person who is present, unit members may smoke in buildings (such as sheds, garages, outbuildings, and the like) where no heating, air conditioning or ventilation systems are installed which would cause others to breathe secondhand smoke. Smoking will also be permitted in all other places except where prohibited by existing law or where special hazards such as explosives, gasoline, highly flammable materials, and the like are present. Enforcement of this provision shall be consistent with public law and employees in violation shall be subject only to civil penalties as prescribed by law. [See Side Letter.]
