Common use of Designation of Series Clause in Contracts

Designation of Series. Pursuant to the terms hereof and Sections 201 and 301 of the Base Indenture, the Company hereby creates a series of its Notes known as the “8% Senior Notes due 2005,” which shall be guaranteed by Homes and such Notes (including the associated Subsidiary Guarantees) shall be deemed “Securities” for all purposes under the Base Indenture.

Pursuant to the terms hereof and Sections 201 and 301 of the Base Indenture, the Company hereby creates a series of its Notes known as the “85% Senior Notes due 20052010,” which shall be guaranteed by Homes and such Notes (including the associated Subsidiary Guarantees) shall be deemed “Securities” for all purposes under the Base Indenture.
