The DESIGN BUILD PHASE clause defines the period and process during which the contractor is responsible for both designing and constructing the project. This clause typically outlines the contractor’s obligations to develop design documents, obtain necessary approvals, and then proceed with construction according to the approved plans. It may also specify milestones, deliverables, and coordination requirements between the design and construction teams. DESIGN BUILD PHASE. 2.6.1 Master Architect shall attend and participate in a pre-construction meeting called by the University’s Representative. Attendees shall be Master Architect’s consultants, Design Builder and major subcontractors, University's Designated Administrator and others as deemed necessary by the University.
2.6.2 The Construction Phase of the Design Build contract will commence on the date the University issues the Notice to Proceed for Phase 3 to Design Builder and will terminate one year after Notice of Completion or, in the absence of a Notice of Completion, one year after Final Completion.
2.6.3 The Master Architect’s responsibilities shall include, but not be limited to, interpretation of the Contract Documents; periodic site observations; review of submittals; preparation of documents for proposed changes; and general consultation to the University on design matters. The Master Architect shall be fully responsible for all matters related to the Master Architect’s design and all of the Master Architect’s recommendations to the University which are carried out by the University without substantive change. The Master Architect’s duties shall not include administration of communications with Design Builder, chairing meetings with Design Builder, monitoring the schedule; negotiation of price changes; and coordination of closeout. Master Architect shall cooperate with the University’s Representative in the University Representative’s provision of contract administration services as those services are described in the Contract Documents. Except as otherwise provided in the Contract Documents or as directed by University, all written communications with Design Builder shall be sent and received by University’s Representative. The Master Architect shall advise and consult with University Representative and shall keep University Representative informed of the observed progress of the Work. The Master Architect shall render written or graphic interpretations and decisions that are consistent with the intent of, and reasonably inferable from, the Contract Documents; review and recommend any action to be taken regarding Design Builder's required submittals; and evaluate, with the University’s Representative, the equivalence of proposed substitutions for materials, products, or services specified by brand or trade names in the Contract Documents and recommend either approval or rejection of substitutions as being equal in quality, utility, and appearance. DESIGN BUILD PHASE. 5.3.1. Perform general criteria conformance reviews of drawings, specifications, and other submissions from the Design Build Entity at 50% and 100% Design Development documents, as set forth above.
5.3.2. Prepare reports documenting nonconformance of any items.
5.3.3. Conduct meetings/follow-up with DBE and Criteria Architect to correct and verify correction of nonconforming items or document acceptance of the variance.
5.3.4. Assist Criteria Architect in preparing a project-specific list of submittals requiring Judicial Council review and approval.
5.3.5. Provide value engineering services when requested by Judicial Council, as set forth above.
5.3.6. Perform submittal reviews when requested and ensure Judicial Council reviews and provides input when required.
5.3.7. Perform review of RFIs and responses, and ensure Judicial Council reviews and provides response when required.
5.3.8. Review DBE’s site logistics plans, traffic flow diagrams, and plans for the performance of the Project, showing the use of designated roadways or streetlights, the closing of any roadways, streets and/or sidewalks, and the re-routing of any traffic.
5.3.9. Perform general criteria conformance reviews of drawings, specifications, and/or other submissions from Design Build Entities at 95% Construction Documents as set forth above.
5.3.10. Record the progress of work at the Project. When present, Construction Manager must prepare daily reports for the Project containing a record of weather, the members of the DBE and its subcontractor(s) present, and their number of workers, work accomplished, problems encountered, and other relevant data.
5.3.11. The Judicial Council hereby authorizes the Construction Manager to execute hazardous waste manifests on its behalf for the transportation and disposal of hazardous waste generated throughout the duration of the project. Pursuant to this delegation of authority, Construction Manager shall prepare and execute all hazardous waste manifests for the Project as set forth below.
DESIGN BUILD PHASE. 2.4.1. Contract for, or employ, at Criteria Architect's expense, a sufficient number of specialists and other workers with requisite skills and experience, as appropriate, to successfully verify Performance Criteria compliance.
2.4.2. Perform Performance Criteria conformance reviews of drawings, specifications, and/or other submissions from Design Build Entities at 50% and 100% Schematic Design, 50% and 95% Design Development, and 50% Construction Documents.
2.4.3. Prepare reports documenting the non-conformance of any items.
2.4.4. Conduct meetings/follow-up with DBE team to correct and verify correction of non-conforming items or document acceptance of the variance.
2.4.5. Define and prepare a project specific list of submittals needed for Judicial Council review and approval.
2.4.6. Perform Submittal reviews to verify compliance with Performance Criteria and conformance with California Trial Court Facilities Standards.
2.4.7. Perform review of RFIs and responses for validation of compliance with Performance Criteria.
