Common use of Derivative Work Clause in Contracts

Derivative Work. “Derivative Work” means a work that is based on the Subscription Material or any portion thereof, such as a revision, modification, abridgement, condensation, expansion, or any other form in which the Subscription Material or any portion thereof may be recast, transformed, or adapted. For purposes of this Agreement, a Derivative Work also includes any compilation that incorporates any portion of the Subscription Material. Further, “Derivative Work” includes any work considered a “derivative work” under United States copyright law.

Derivative Work. “Derivative Work” means a any work of authorship that is based on the Subscription Material based, in whole or any portion thereofin part, upon one or more pre-existing works, such as a revision, modification, abridgementtranslation, abridgment, condensation, expansion, or any other form in which the Subscription Material or any portion thereof such pre-existing work(s) may be recast, transformed, or adapted. For purposes of this Agreementadopted, a Derivative Work also includes any compilation that incorporates any portion and which, if prepared without authorization of the Subscription Material. Furtherowner of the copyright in such pre-existing work(s), “Derivative Work” includes any work considered would constitute a “derivative work” under United States copyright lawinfringement.
