Deputies. The provisions of this chapter apply to a deputy chief shop ▇▇▇▇▇▇▇ and to a deputy occupa- tional safety and health representative for the period during which said deputy is serving as a deputy in accordance with this agreement. If the employer terminates the employment contract of the deputy chief shop ▇▇▇▇▇▇▇ or lays off said employee at a time when the latter is not working as a deputy to the shop ▇▇▇▇▇▇▇ or does not otherwise enjoy the status of a shop ▇▇▇▇▇▇▇, then said dismissal or layoff shall be deemed to be due to the employee’s shop ▇▇▇▇▇▇▇ duties, unless the employer can prove that it was due to some other reason.

If the employer terminates the employment contract of the deputy chief shop ▇▇▇▇▇▇▇ elected representative or lays off the said employee at a time when the latter is not working as a deputy to deputising for the shop ▇▇▇▇▇▇▇ elected representative or does not otherwise enjoy the status of a shop ▇▇▇▇▇▇▇an elected representative, then the said dismissal or layoff shall be deemed to be due to the employee’s shop ▇▇▇▇▇▇▇ duties, duties as an elected representative unless the employer can prove that it was due to some other reason.

If the employer terminates the employment contract of the deputy chief shop ▇▇▇▇▇▇▇ or temporarily lays off the said employee at a time when the latter individual in question is not working as a deputy to deputising for the shop ▇▇▇▇▇▇▇ or does not otherwise enjoy the status of a shop ▇▇▇▇▇▇▇, then the said dismissal or layoff shall must be deemed to be have taken place due to the employee’s duties as a shop ▇▇▇▇▇▇▇ duties, unless the employer can prove that it was due to some other reason. This assumption based on the provisions of the agreement is in force for the duration of the deputy’s term of office and six months after the term has come to an end.
