Delivery Delays. The BPA Holder is required to meet the timeframes stated in section 5.2.1 unless the U.S. Customs and Border Protection or foreign customs approval and/or review activities prevent the BPA Holder from meeting these timeframes. In the event that the BPA Holder determines they are unable to achieve the stated timeframes, the BPA Holder shall notify the Ordering Agency Contracting Officer within two (2) business days of such determination, or immediately upon such determination if operating under the Emergency/War Tempo timelines.
