Definitions Attachments. 1.9.1 Capitalized terms used in this Agreement, including in the Attachments attached hereto, unless otherwise defined in this Agreement, shall have the respective meanings specified in the Glossary of Defined Terms attached hereto as Attachment 1. Unless otherwise indicated, references in this Agreement to sections, paragraphs, clauses, exhibits, attachments and schedules are to the same contained in or attached to this Agreement and all attachments and schedules referenced in this Agreement are incorporated in this Agreement by this reference as though fully set forth in this Section. 1.9.2 Wherever used in this Agreement, the term “substantially in the form and substance of” shall mean that the referenced document, when compared to the previously approved form of document, is consistent in all material respects, and none of the modifications in the referenced document diminish a party’s rights or increase such party’s obligations thereunder, as determined by the party for whose benefit the condition is written, in its sole discretion.
