Definition of accident pay. (i) Accident pay shall mean a weekly payment of an amount being the difference between the weekly amount of compensation payable to an incapacitated Employee pursuant to the said Workers’ Compensation Legislation and an amount equal to the pre-injury average earnings (as defined in the legislation) of the Employee immediately prior to the incapacity.
