Deficient Performance by Third Party Sample Clauses
The 'Deficient Performance by Third Party' clause defines the rights and remedies available when a third party engaged by one of the contracting parties fails to perform their obligations adequately. Typically, this clause outlines the process for identifying deficient performance, the responsibilities of the party who engaged the third party, and the steps required to remedy the situation, such as requiring the third party to correct their work or allowing the non-breaching party to seek alternative solutions. Its core function is to allocate responsibility for third-party failures and provide a clear mechanism for addressing such issues, thereby minimizing disruption and ensuring accountability within the contractual relationship.

LAWA may withhold further funding for the program or activity until appropriate safeguards have been implemented to allow achievement of satisfactory performance.
