The Artist further represents that no breach of the CTA or any CTA Engagement Contract remains unsettled. The subject matter of a dispute for which an unresolved claim has been presented, or which is in arbitration or for which notice of arbitration has been given, shall not be deemed an unsettled breach.

Defaulting Artists. Any Equity member entering into a CTA Engagement Contract with a Theatre represents that he/she is not in default with regard to any payments or penalties required by this Agreement or any CTA Engagement Contract, or required by the interpretation, or arbitration of this Agreement or any CTA Engagement Contract. (A) Once it is agreed by Equity and PACT that an Artist is in default of termination payments or other monies due a Theatre, or where it has finally been determined that an Equity member has failed to fulfil any settlement or arbitration award, Equity agrees that it will use the disciplinary procedures in its Constitution and By-Laws to ensure fulfilment of the Artists obligations to the Theatre. (B) It is understood and agreed that upon satisfaction of the above-mentioned payments, settlements, awards or penalties by the Artists, no Theatre shall penalize or discriminate against any such Artist.
